Chapter One- Definitions and Mission

Preamble: The National Olympic Committee of the Islamic Republic of Afghanistan (hereinafter “the Committee”), belonging to the Olympic Movement is a non-governmental not-for- profit sports organization with no discrimination to race, religion and free of politics. The Committee was recognized by the IOC in 1936 and in 1949 the committee became a founding member of Asian competitions. The Committee belongs to the Olympic Movement and undertakes to respect the provisions of the Olympic Charter and the World Anti-Doping Code and to abide by the decisions of the IOC. Based on IOC guidelines, the NOC of Afghanistan undertakes, in accordance with its mission and role at national level, to participate in actions to promote peace and to promote women in sport. It also undertakes to support and encourage the promotion to sports ethics, to fight against doping and to demonstrate a responsible concern for environmental issues.

Article One – Definitions: – The Olympic Charter (OC): The Olympic Charter is a legal document which contains the basic principles and fundamental values of the Olympic Movement. Whilst being recognized as the “statutes” of the International Olympic Committee, the Olympic Charter also specifies the mutual rights and principal obligations of official and active organizations existing within the global sport structure including the National Olympic Committees and determines the criteria required for the activities of such organizations.

– International Olympic Committee (IOC): The IOC is an international non-governmental not-for-profit organization, of unlimited duration, in the form of an association with the status of a legal person, recognized by the Swiss Federal Council in accordance with an agreement entered into on 1 November 2000.

– National Olympic Committee (NOC) of the Islamic Republic of Afghanistan: The National Olympic Committee of the Islamic Republic of Afghanistan (hereinafter “the Committee”) is an independent non-profit and non-governmental organization of

unlimited duration which is operationally independent and functions in compliance with the Olympic Charter far from any racial, religious and political inclinations. The Committee exercises its jurisdiction over the whole territory of the Islamic Republic of Afghanistan.

– International Federation (IF): Based on Rule 25 of Olympic charter, an International Federation (IF) is an independent non-governmental organizations administering one or several sports at world level and encompassing organizations administering such sports at national level.

– National Federation (NF): A National Federation is a non-governmental organization which functions as governing body for one or more sports at national level and is internationally a member of the respective International Federation.

Article Two – Mission:

According to Rule 27.1 of Olympic charter, the mission of the AFG NOC is to develop, promote and protect the Olympic Movement in Afghanistan, in accordance with the Olympic Charter.

The Committee shall respect all fundamentals and objectives of Olympic charter and feels responsible to develop and maintain Olympic activities, human values, promote athletic ethics, develop the level of women sports and Anti-Doping activities.

The Olympic Committee shall help and support member federations to develop the qualities and quantities of their respective kind of sport, particularly helping the Olympic and other sports events approved by international Olympic Committee to take place in the best way possible.

Maintaining the living environment and contribution to peace is one of the all-time commitments of Olympic Committee, which the organization will stay fully committed to that.

Chapter Two -Duties

Article Three – Duties: a) To observe and implement the Olympic Charter, international sport rules and other IOC-approved regulations and disseminate the basic principles and values of the Olympic Movement at national level;

b) To develop competitive sports in the country, based on a scientific approach, particularly through preparing grounds for the development of potential talents; and promote the physical, psychological and intellectual abilities of athletes;

c) To expand “Sport for All” particularly by organizing the public and encouraging the people to practice sports and safeguard their health and hygiene through sport; and train the young future-making generation of the country; d) To take the necessary measures against any discrimination, violence and corruption in sport; to disseminate sport ethics and fight against doping; to adopt and implement the World Anti- Doping Code, thereby ensuring that the Committee’s anti-doping policies and rules, membership and/or funding requirements and results management procedures conform with the World Anti-Doping Code and respect all the roles and responsibilities for NOCs that are listed within the World Anti-Doping Code;

e) To assist and support the national sports federations in exercising their respective activities in an autonomous manner and in close collaboration and coordination with the International Sports Federations to which they are affiliated. The national sports federations must be in a position to exercise their activities in accordance with the rules of their respective International Federations and their respective statutes shall be subject to approval of their respective International Federations. When any issue arises with respect to a national sport federation, the Committee must immediately inform and consult with the International Federationconcerned and must work together with this national federation and the International Federation concerned to find a jointly acceptable solution.

f) To prepare and communicate the minimum standards for a national sports federation to benefit fully from the assistance of the Committee, provided that such standards do not conflict with any regulations of the International Federations to which the national sports federations are affiliated and with the current national rules. g) To apply supreme management and supervision on the trend of preparation, selection and dispatch of athletes to the Olympic and Asian Games as well as regional events and any other games recognized by the International Olympic Committee. In line with Rule 27.3 of the Olympic charter the committee have the exclusive authority for the representation of the Islamic Republic of Afghanistanat the Olympic Games and at the regional, continental or world multi-sports competitions patronized by the IOC. In addition, AFG NOC is obliged to participate in the Games of the Olympiad by sending athletes;

h) To expand efficient international communication with all sports bodies active in the field of sport particularly with the International Olympic Committee, the Olympic Council of Asia, International Federations, Continental Confederations, National Olympic Committees and other recognized international organizations active in sport; i) To draw up and implement cultural, art, educational and research programs based on sport sciences; and enhance human resources through setting up and managing scientific, cultural and art institutions such as the National Olympic Academy and the

Olympic Museum;

j) To extend a full support to sports for the disabled and the war-wounded and assist in providing needed funds for the National Paralympic Committee; and cooperate with the NPC in making available scientific and educational services;

k) To provide possible assistance to representative offices and secretariats of the IOC- recognized international federations, Asian confederations and other international bodies based in Afghanistan; and extend full support to competent Afghan representatives in acquiring and preserving official sport positions in international organizations;

l) To assist in developing women sports in the country in all dimensions quantitatively and qualitatively;

m)To support public organizations active in the field of sport within the country, in particular, sport clubs, university and school teams and teams belonging to Afghan Armed Forces within the possibilities of the Committee;

n) To select from the cities of the country, the candidate city applying to host the Olympic Games and other events recognized by the International Olympic Committee. The Committee has exclusive rights in this respect;

o) To set up and manage economic institutions and companies, if necessary, towards raising funds for the Committee and to sign contracts with financial sponsors provided that the collection of funds shall serve exclusively for the Committee to accomplish the mission, role, objects, duties and activities for which it is established according to the Olympic Charter and the present Statutes;

p) To cooperate and establish good relations with governmental and non- governmental organizations which can assist the Committee to achieve its objectives and discharge its duties. However, this cooperation must not be contradictory to the Olympic Charter or result in any form of interference by the said organizations;

q) To confront any political, legal, religious, social and economic pressures or any demands or influence exerted by true and legal persons, legal entities, governmental and non-governmental organizations and groups, which are contradictory to international sport rules and the Olympic Charter. The Committee shall preserve its independence under all circumstances;

r) To compile, author, translate and publish books as well as sportive, cultural, art, scientific and news publications and essays related to the objectives and duties of the Committee; and create databases as required;

s) To celebrate the Olympic Day or Week annually for holding Olympic-related celebrations;

t) To prepare the flag, emblem and anthem of the Committee which must be approved by both the Committee’s Executive Board and the International Olympic Committee;

Note: Except for the specific mission, roles, objects and duties which are derived from the Olympic Charter and which must be fully exercised by the Committee under its exclusive jurisdiction and responsibility, the Committee may delegate part of its other duties to other national sports bodies and organizations provided that such delegation of duties is approved by the Executive Board and the General Assembly.

Chapter Three –The Bodies of the Committee

Article Four – Bodies of the Committee:

The bodies of the Committee are as follows: a) The General Assembly b) The Executive Board c) The General Secretariat d) The National Teams’ Monitoring Center

Chapter Four – General Assembly

Article Five – Composition of the Assembly:

a) Any Afghan IOC member(s);

b) Three representatives from among active or retired Olympians having participated in, at least, one of the last three editions of the Olympic Games. At least one of these Olympians shall be elected from women athletes. The Athletes Commission established according to the IOC guidelines shall elect these Olympians.

This election shall be based on two main criteria: the athlete’s level of achievement at the Olympic Games and his/her ethical characteristics;

c) The presidents of national federations or, in case of absence of the president, a representative duly appointed by and from among the executive body of the national federation, which are members of their respective international federations whose sports are included in the Olympic Games program (see the current list of those federations which are members of the Committee in Annex 1 of the present statute). Note: According to the Olympic Charter, this category of members must always constitute the voting majority of the General Assembly of the Committee.

d) The presidents of national federations or, in case of absence of the president, a representative duly appointed by and from among the executive body of the national federation, which are members of their respective international federations whose sports are not included in the programme of the Olympic Games but are included in the Asian Games program (see the current list of those federations which are members of the Committee in annex 2 of the present Statutes).

e) The presidents of national federations or, in case of absence of the president, a representative duly appointed by and from among the executive body of the national federation, whose sports have deep roots in Afghan’s rich culture (see the current list of those federations which are members of the Committee in annex 3 of the present Statutes).

f) The members of the Committee’s Board of Management;

Note1: Other interested true or legal persons may be included in the composition of the Assembly with the approval of the General Assembly and without a right to vote. Such persons shall be admitted as members in accordance with a by-law to be approved by the General Assembly. The General Assembly is the highest decision-making body of

the NOC which should decide on the affiliation of any new member Voting or non- voting) as per article 6 of this statutes.

Note 2:. No person expelled from the International Olympic Committee shall be admitted as a member to the Assembly.

Note 3: All the members of the Assembly must be Afghanistan Citizen, and be known as having good ethical standing and good reputation in the society.

Note 4 : Governmental and public authorities and officials cannot appoint any of the members of the Committee

Note 5: Affiliation of new members: Any member wishing to apply for membership to the Committee shall apply to the Executive Board and the application shall be presented at the next General Assembly for final decision.

Note 6: Termination of Membership: A member may cease to be a member for the following reasons:

a. With respect to a federation / legal entity:

Upon dissolution or declaration of insolvency;

Upon cessation of membership if the member does no longer fulfill the requirements of the present Statutes;

Upon expulsion in case of violation of the present Statutes and/or the Olympic Charter and/or the IOC’s Code of Ethics, subject to a decision made by the General Assembly and after having given a reasonable opportunity to the member concerned to be heard. Such decision shall be made by a majority of at least 2/3 of the votes cast by the voting members present.

b. With respect to natural persons:

Upon death, resignation or loss of the position for which he/she is entitled to be a member;

Upon conviction of a criminal offense;

Upon expulsion in case of violation of the present Statutes and/or the Olympic Charter and/or the IOC’s Code of Ethics, subject to a final decision made by the General Assembly and after having given a reasonable opportunity to the member concerned to be heard. Such decision shall be made by a majority of at least 2/3 of the votes cast by the voting members present.

Note 7: Measures and Sanctions: When a member has failed to fulfil its duties and tasks, has infringed the present Statutes, the Olympic

Charter and/or the IOC’s Code of Ethics, thus endangering the interests, dignity and reputations of the Committee or has not respected or implemented the decisions or resolutions of the organs of the Committee, or fails to comply with the conditions of membership as provided under the present Statutes, it is subject to the following graduated measures and sanctions (depending on the gravity of the facts and the level of damage or infringement): – Warning – Suspension – Expulsion Decision to pronounce a warming can be made by the Executive Board after having given a reasonable opportunity to the member concerned to be heard. The Executive Board shall report accordingly at the next meeting of the General Assembly.

Decision to pronounce a suspension or an expulsion is made by the General Assembly after having given a reasonable opportunity to the member concerned to be heard. Such decision shall be made by a majority of at least two third of the votes cast by the voting members present.

Note 8: The Committee shall not recognize more than one national federation for each sport governed by an IF. In addition, to be recognized by the Committee and accepted

as a member of the Committee, a national federation must exercise a specific, real and ongoing sports activity, be affiliated to an International Federation recognized by the IOC and be governed by and comply in all aspects with both the Olympic Charter and the rules of its International Federation.

Note 9: Registry of Members: A members’ registry must be established and kept regularly up-to-date under the responsibility of the Secretary General. This registry shall, in particular, include the following information: member’s name and address; date of membership; type of membership; membership status.

Article Six – Duties and Powers of the General Assembly: The General Assembly is the highest decision-making authority in the Committee and shall have in particular the following duties and powers:

a) To study, evaluate and adopt the Committee’s annual performance report which shall be presented to the Assembly by the Secretary General after the approval of the Executive

Board;

b) To examine and approve the financial reports and audited statements of the Committee which shall be presented to the Assembly by the Treasurer after the approval of the

Executive Board;

c) To study and approve the action plan and budget of the Committee for the subsequent year drawn up by the Executive Board;

d) To make decision upon the affiliation of any member to the Committee and to decide to suspend or expel any member of the Committee;

e) To study and approve the proposals presented by the Executive Board regarding the amendments of the

Committee’s Statutes;

f) To study and decide over the proposals and plans submitted to the Assembly;

g) To elect the members of the Executive Board after termination of their tenure of office or in case of any vacancy in the positions within the Executive Board.

h) To interpret the Statutes and by-laws of the Committee and make final decisions if case of any doubt, subject to the rules of the Olympic Charter.

i) To consider and make decision upon any matter that is brought to the agenda of the Assembly.

Note: Any bye-laws pertaining to points “f” and “g” of this article shall be drawn up by the Executive Board and approved by the General Assembly.

Article Seven – The Meetings of the Assembly: The General Assembly shall hold both ordinary and extraordinary meetings as follows:

a) Ordinary meetings must be held at least once a year. The agenda of the ordinary meetings shall be determined by the Executive Board based on the duties and powers of the Assembly (as specified in article 6 of the present Statutes);

b) Extraordinary meetings shall be held anytime at the written request of at least one- third of the voting members of the General Assembly or of at least one-half of the members of the Executive Board indicating the reasons for such a request. The notification must be sent with the agenda 3 days before the meeting to the GA members.

Article Eight – Notice for the Meetings of the General Assembly: Notice for any meetings of the Assembly shall be sent by the General Secretariat to all members of the Committee at least twenty-one (21) days prior to the meeting, indicating

the date, time, place and agenda for the meeting. Any proposal from any voting member of the Committee to include a specific matter in the agenda of the meeting shall be submitted in writing to the General Secretariat no later than ten (10) days prior to the meeting and shall be circulated to all members by the General Secretariat.

Article Nine –Quorum for the Meetings of the General Assembly: Unless otherwise indicated in these statutes, the quorum for any General Assembly Meeting shall be at least one-half of the voting members of the Committee provided always that the delegates of the National Federations affiliated to International Federations governing sports on the programme of the Olympic Games constitute a voting majority. In the event of a quorum not being present within an hour of the time fixed for a meeting, the meeting shall be adjourned for a period of two weeks at the same time and place. If at such adjourned meeting a quorum is not present, then the Chairman shall conduct the meeting with those members present provided always that the delegates of the National Federations affiliated to International Federations governing sports on the programme of the Olympic Games constitute a voting majority.

Article Ten: Chairman of the Meetings of the General Assembly: Meetings of the General Assembly shall be chaired by the President. In the absence of the President, the First Vice President shall preside. In the absence of the First Vice President, the Second Vice President shall preside. In the absence of all of them, the Meeting shall elect a Chairman from among the members present and entitled to vote.

Article Eleven: Voting at Meetings of the General Assembly: Voting at Meetings of the General Assembly shall be as follows: a) Each member/delegate mentioned under Article Five a), b), c), d) and e) of these Statutes shall have one vote. b) The voting majority of the Meetings must consist of the votes cast by the delegates of the national associations affiliated to the International Federations governing sports included in the programme of the Olympic Games. c) In addition, when dealing specifically with questions relating to the Olympic Games, only the votes cast by the delegates of the National Associations affiliated to the International Federations governing sports included in the programme of the Olympic Games are taken into consideration.

d) Unless otherwise indicated in these Statutes, voting shall be by a show of hands unless a vote by secret ballot is requested by at least two voting members or delegates present at the Meeting. e) Voting shall be by secret ballot when elections take place. f) Voting by proxy is not allowed.

Article Twelve: Decisions at Meetings of the General Assembly: Unless otherwise indicated in these Statutes, decisions shall be taken by simple majority (at least 50%) of the votes cast by the voting members/delegates present. In the event of tie, the Chairman of the meeting shall have a casting vote (except for elections).

Unless otherwise mentioned by the General Assembly, the decisions of the Assembly shall come into force immediately or after it is notified to the concerned bodies (when applicable).

Article Thirteen: Minutes of the Meetings of the General Assembly: The Secretary General (or in his/her absence any staff of the General Secretariat or any member/delegate present designated by the Chairman of the Meeting) shall be responsible for preparing and forwarding the minutes of the Assembly meetings to all members of the Committee and to the International Olympic Committee and the Olympic Council of Asia within one week from the date of the Assembly meeting.

Chapter Five- Executive Board

Article Fourteen – The Composition of the Executive Board: The executive board should be composed of 15 members as follows:

1. President

2. 3 vice presidents (one Female & 2 Male VPs)

3. Secretary General

4. Assistant Secretary General

5. Treasurer

8. One Athlete representative fulfilling the conditions mentioned in the Rule 28.1.3 of the Olympic Charter

Note 1: All those members (except for the Secretary General who is a non-voting member appointed by the Executive Board) must be elected by the General Assembly from among its voting members and the nominees submitted by its voting members,

Note 2: As per the Olympic Charter, the representatives of the national federations affiliated to the International Federations governing sports included in the programme of the Olympic Games must constitute the voting majority of the Executive Board. In other words, this means that at least 8 members of the Executive Board shall be representatives of national federations affiliated to the International Federations governing sports included in the programme of the Olympic Games.

Note 3: Both genders shall be represented within the Executive Board.

Note 4: In addition, any Afghan IOC member(s) shall be ex-officio voting member(s) of the Executive Board. Note 5: The President, 1st Vice president, 2nd Vice President, 3rd Vice President, Secretary General and Treasurer shall constitute the members of the Board of Management.

Article Fifteen – Executive Board Elections:

Election to the Executive Board should be opened to Afghan citizens voting members of the Committee and nominated by any voting members of the Committee, provided that the nomination is supported in writing by at least one of the voting National Federation duly affiliated to the Committee and provided further that the nomination for the position of the President is supported in writing by at least five voting National Federations duly affiliated to the Committee.

Note 1: The candidates of all Executive Board positions must be known as having good ethical standings with an effective sport management background.

Note 2: The candidates applying for the position of Treasurer, in addition to meeting the conditions cited in Note 1, must at least have a Bachelor’s degree as well as three years of financial management background in the sport of the country or a university degree in finance-related field of study.

Note 3: Nomination forms must be circulated by the General Secretariat to all voting members at least twenty-one (21) days prior to the Elective General Assembly together with the notice of the Meeting.

Note 4: All nominations shall be in writing on the prescribed form signed by the nominee, and shall be submitted to the General Secretariat no later than ten (10) days prior to the elections along with the required documents including a brief background. The nominee shall get a receipt in return. No application shall be accepted after the deadline. All voting members of the General Assembly shall be notified by the Committee’s Secretariat of the names and brief background of all candidates for each position no later than seven (7) days before the elections.

Note 5: The individuals may apply for two positions in the Executive Board as candidates, but in case of being elected, they are permitted to have only one position; having received sufficient votes for their first choice, they shall automatically be eliminated from the list of candidates of their second choice.

Note 6: The elections shall be held in writing and with secret ballots according to the following order:

a) The election for the position of President (Note: To be elected a candidate must obtain at least 50 % + 1 of the votes validly cast. If there are more than two candidates and none of them obtains at least 50% + 1 of the votes validly cast in the first round, there shall be a second round between the two candidates obtaining the highest number of votes validly cast in the first round. In this second round, the candidate obtaining 50 % + 1 of the votes validly cast shall be declared elected.)

b) The elections for the positions of Vice Presidents (simultaneously) (Note: the candidate obtaining the highest number of votes shall be elected automatically as the First Vice President and the second one and third one shall be elected automatically as the Second Vice President and third Vice President).

c) The election for the position of Treasurer (Note: To be elected a candidate must obtain at least 50 % + 1 of the votes validly cast. If there are more than two candidates and none of them obtains at least 50% + 1 of the votes validly cast in the first round, there shall be a second round between the two candidates obtaining the highest number of votes validly cast in the first round. In this second round, the candidate obtaining 50 % + 1 of the votes validly cast shall be declared elected.)

d) The elections for the positions of six Executive Board members (simultaneously). The six candidates obtaining the highest number of votes should be declared elected.

e) The election for the athletes’ representative (Note: To be elected a candidate must obtain at least 50 % + 1 of the votes validly cast. If there are more than two candidates and none of them obtains at least 50% + 1 of the votes validly cast in the first round, there shall be a second round between the two candidates obtaining the highest number of votes validly cast in the first round. In this second round, the candidate obtaining 50 % + 1 of the votes validly cast shall be declared elected.)

Note 7: In the Assembly meetings where elections are held, the Assembly shall appoint three scrutineers from among the members to conduct and supervise the process of the elections. None of the appointed scrutineers must be candidate for the positions of the Executive Board, they must be independent and neutral and they must have no conflict of interest with the elections.

Article Sixteen – Term of Office for Executive Board Positions: All the Executive Board members (except for the Secretary General who is appointed by the Executive Board) shall be elected for a 4-year term of office and their re-election for the subsequent terms is possible if they still meet the eligibility conditions mentioned in these Statutes.

Note 1: The functions of any member(s) of the Executive Board shall be terminated before the end of the 4-year term in the following circumstances: – Death or incapacity – Resignation submitted in written to the Committee – Upon decision taken by at least 2/3 of the voting members present at an Extraordinary General Assembly convened specifically for that purpose

when a member of the Executive Board has failed to fulfil his/her duties and tasks, has infringed the present Statutes, the Olympic Charter and/or the IOC’s Code of Ethics; provided that the member(s) concerned has/have received a statement of reasons and has/have been given a reasonable opportunity to be heard before the Extraordinary General Assembly.

Note 2: Any vacancy occurring as a result of the above shall be filled by election at the next General Assembly Meeting (ordinary or extraordinary) for the remainder of the initial term of office.

Note 3: The elected Executive Board members who represent the national federations at the time of elections shall be the members of the Executive Board until the end of 4-year term of office.

Article Seventeen – The Duties and Powers of the Executive Board and the members of the Executive Board:

1. The main duties and powers of the Executive Board are as follows: a) To lead and direct all the affairs of the Committee including the administrative, financial, technical and international matters;

b) To prepare the annual action plan and budget of the Committee to be submitted to the General Assembly for approval;

c) To appoint the managerial positions of the Committee such as the directors of the NOC, the persons in charge of the various sections of the National Teams’ Monitoring Center, Commissions, sport delegations and the National Olympic Academy;

d) To appoint the Committee’s representatives participating in international forums and congresses;

e) To cooperate and support the national federations and other national sport bodies in international forums and extend any assistance to the Afghanindividuals who hold positions in international federations, Asian confederations and other international sports organizations recognized by the International

Olympic Committee;

f) To examine and approve all the missions organized by the Committee and approve individuals selected for a single or group mission;

g) To study and approve the internal bye-laws of the Committee codified to govern the Committee’s own affairs such as those of administration, employment, finance and transactions;

h) To study and approve the organizational chart and the human resources structure of the Committee.

i) To exercise any other power and responsibility as delegated by the General Assembly within the framework of these Statutes.

Note 1: The Executive Board and the members of the Executive Board are accountable to the General Assembly for their work.

Note 2: Urgent decisions can be taken by the Board of Management between two meetings of the Executive Board subject however to ratification at the next Executive Board meeting.

Note 3: The Executive Board may delegate a part of its duties to the Board of Management or any of the latter’s members.

2. The main duties of the members of the Executive Board shall be as follows:

a) President: The President shall be the legal representative ofthe Committee. The President shall supervise the general running of the Committee and ensure that the Committee operates in accordance with the Olympic Charter and these Statutes and the decisions of its bodies are respected and implemented. The President shall

preside over the meetings of the General Assembly and Executive Board. The President shall exercise any other duties assigned by the General Assembly or the Executive Board in the framework of these Statutes.

b) Vice Presidents: they are (3 vice presidents) and in case of the absence of the president; the vice presidents by order of seniority (1st Vice President, 2nd vice President, 3rd Vice President) will replace him/her. He/she shall exercise any other duty assigned by the General Assembly or the Executive Board in the framework of the Statute.

c) Secretary General and Assistant Secretary General: both the Secretary General and Assistant Secretary General are appointed by the Executive Board as full time professional positions with a working contract. The Secretary General is responsible for the General Secretariat and administration as mentioned also in Article Twenty of these Statutes.

In particular he or she is responsible for sending notices and related documents for the meetings; preparing the reports of the Committee for presentation to the Executive Board and General Assembly; taking the minutes of the meetings of the General Assembly and Executive Board; keeping all registers and records of the Committee.

The Secretary General shall also exercise any other duties assigned by the General Assembly, the Executive Board or the President in the framework of these Statutes. In case of the absence of the Secretary General the Assistant Secretary General will carry out the duty of the Secretary General.

d) Treasurer and assistant treasurer: The Treasurer shall exercise his/her functions as specified in Chapter Nine of these Statutes. The Treasurer shall also exercise any other duties assigned by the General Assembly, the Executive Board or the President in the framework of these Statutes. In case of the absence of the Treasure, The assistance Treasure will carry out the duty of Treasurer.

e) Members of the Executive Board: The members of the Executive Board shall actively contribute to the activities of the Executive Board and can be entrusted with

specific tasks assigned by the General Assembly, the Executive Board or the President in the framework of these Statutes.

f) Athletes’ representative: The athletes’ representative shall represent the views, rights and interests of the athletes and make their voice heard within the Executive Board. He or she shall in particular make recommendations to the Executive Board on issues related to athletes. He or she can be entrusted with specific tasks assigned by the General Assembly, the Executive Board or the President in the framework of these Statutes.

Article Eighteen – The Executive Board Meetings:

Regular meetings of the Executive Board shall take place at least once a month.

The Extraordinary meetings can be held anytime at the written request of at least 1/3 of the members of the Executive Board or at the request of the President.

Notice shall be sent by the General Secretariat to all members of the Executive Board at least seven (7) days prior to the meeting, indicating the date, time, place and agenda for the meeting. Any proposal from any member of the Executive Board to include a specific matter in the agenda of the meeting shall be submitted in writing to the General Secretariat no later than three (3) days prior to the meeting and shall be circulated to all members by the General Secretariat.

The quorum for the meetings of the Executive Board shall be at least one-half of the voting members of the Executive Board.

Meetings of the Executive Board shall be chaired by the President. In the absence of the President, the First Vice President shall preside. In the absence of the First Vice President, the Second Vice President shall preside. In the absence of all of them, the Meeting shall elect a Chairman from among the members present and entitled to vote.

Voting at Meetings of the Executive Board shall be as follows:

– Each voting member of the Executive Board shall have one vote.

– Voting shall be by a show of hands unless a vote by secret ballot is requested by at least two voting members present at the meeting.

– Voting by proxy is not allowed.

Decisions shall be taken by simple majority (at least 50%) of the votes cast by the voting members present. In the event of tie, the Chairman of the meeting shall have a casting vote.

The Secretary General (or in his/her absence any staff of the General Secretariat or any member present designated by the Chairman of the Meeting) is responsible for establishing the minutes of the meetings of Executive Board. The minutes shall be circulated to all members of the Executive Board within 7 days following the meeting.

Article Nineteen: The services of the Executive Board members shall be gratuitous, and membership in the Executive Board is not considered as a job. The members shall not have operational responsibilities and duties, hence they do not receive salaries in return for their services. However, at times of assignments and missions, they may be compensated for the travel expenses and receive remunerations according to the relevant regulations.

Note: The Secretary General is a non-voting member appointed by the Executive Board and shall discharge the executive duties and responsibilities of the Committee entrusted to him by the present Statutes. He shall perform his duties on a full time basis and is therefore considered as an exception to this article. The salary and advantagesof the Secretary General shall be paid in accordance with the regulations adopted by the Executive Board.

Chapter Six -General Secretariat

Article Twenty – The Duties and Powers of the Secretary General:

The Secretary General shall be responsible for implementing the decisions of the Executive Board and shall have full authority to carry out all the Executive affairs of the Committee after the approval of such by the Executive Board. He shall be in charge of the administration (General Secretariat) and shall carefully supervise the operational side of the duties of the Committee.

Note: Should the Committee be in need of the services of individual(s) who are employee(s) of the governmental or non-governmental organizations, the latter shall cooperate with the Committee in granting such individual(s) the necessary assignments.

Chapter Seven – The National Team’s Monitoring Center

Article Twenty One – The Duties and Powers of the Center:

The main duties of the National Teams’ Monitoring Center are as follows:

a) To direct, monitor and evaluate the plans and performance of national federations with regard to their preparation and participation in international events which fall under the authority of the Committee. The Center shall have to present regular monthly reports of its activities to the Executive Board;

b) To cooperate and interact closely and cordially with the national federations’ officials, particularly with the national teams’ committees of the federations toward a smooth implementation of the approved programs and also present modifying comments to improve the trend of the preparation of athletes and national teams;

c) To study and present technical and management analysis report and make decision- planning with regard to participation of Afghan teams in multi sports events taken up in the Executive Board’s working agenda;

d) To take appropriate measures toward a successful participation of Afghan sports delegations in various Games in cooperation and coordination with the respective chefs de mission;

e) To prepare standard monitoring and evaluation forms for assessing national federations’ performance. The performance evaluation reports of the federations shall be prepared and submitted to the Executive Board;

f) To carry out other related duties entrusted to the Center by the Executive Board.

Note: The programs and plans drawn up by the Center shall be implemented after the approval of the Executive Board.

Article Twenty Two – Structure of the Center: a) The Board of Management: This Board shall be composed of a chairman, deputy chairman (2), a secretary and a treasurer;

b) The Center’s Committees; There shall be six committees namely:

– Planning and Budgeting Committee – Scientific Committee – Medical Committee – Psychology Committee – Cultural Committee – Physical Abilities Assessment and Measurement Committee

c) The Technical Analysis and Evaluation Council: This Council shall function as liaison between the Executive Board and the Center’s bodies and is responsible for ensuring the good quality of the Center’s services and also for monitoring the smooth workflow of the Center.

Note 1: The members of the Center’s Board of Management and other officials and members having positions at different levels within the Center, shall be appointed by the Executive Board. The heads of committees shall be appointed at the proposal of the

Center’s chairman and members of the committees shall be appointed as proposed by the heads of the respective committees.

Note 2: The letters of appointment for the members of the Board of Management, heads of committees and the head of the Technical Analysis and Evaluation Council shall be signed by the President while the appointment letters for other members shall be signed by the Secretary General.

Note 3: The Technical Analysis and Evaluation Council shall be composed of a head and three to five member and all committees functioning under the umbrella of the Center shall have a head and two to 4 member. The number of members for both bodies shall be determined at the discretion of the Executive Board.

Note 4: As of necessity, the Executive Board may decide to change the structure, composition and duties of the Center’s committees, and shall notify all the concerned bodies of such changes for implementation. However, such changes shall have to be ratified by the Assembly in its first meeting.

Article Twenty Three – Main Duties of the Center’s Committees:

1- Planning and Budgeting Committee:

a) To set up a timeline table for the activities of the Center; b) To categorize national federations and different sports disciplines in cooperation with other committees for a target–oriented budgeting;

c) To set up the general framework of the federations’ programs with the cooperation of the other committees;

d) To draw up the draft version of the agreements between the Committee and the federations stipulating therein, the obligations and the necessary budget resources;

e) To cooperation the allocation and program-oriented implementation of the federations’ budgets.

2- Scientific Committee:

a) To prepare and control the performance timeline forms of national teams (their trainings and competitions, etc.);

b) To examine the technical (operational) programs of national federations and ensure that such operations correspond with up-todate sport sciences;

c) To provide, at the request of national federations, technical advice with regard to developing national teams’ programs and present appropriate solutions to propounded matters;

d) To organize educational workshops and programs with the aim of updating the knowledge of the technical personnel and managers of national teams.

3- Medical Committee:

a) To provide complementary insurance coverage for national teams’ athletes and prepare specific medical data dossier compiled for every athlete;

b) To control the nutritional and rehabilitation programs prepared for athletes participating in training camps;

c) To take preventive measures, control and fight against the use of doping by athletes;

d) To improve hygienic conditions in the national teams’ preparation camps;

e) To make the necessary coordination regarding the medical coverage of sports delegations of the country.

4- Psychology Committee:

a) To find access to information on athletes such as their backgrounds as well as their psychological and social conditions with the purpose of analyzing their psychological skills growth;

b) To determine the psychological health condition of athletes in different dimensions and identify the levels of their anxiety and motivation; c) To help raise the psychological skill levels of athletes and take preventive measures to that effect;

d) To help employ experienced sports psychologists in the national team camps.

5- Cultural Committee:

a) To confirm the liaison officers appointed by national federations; b) To identify the cultural problems of the national federations; c) To motivate the national teams’ athletes to promote their ethical virtues;

d) To prepare specific and cultural art programs for athletes, officials and technical personnel of Afghan delegations.

6- Physical Abilities Assessment and Measurement Committee:

a) To prepare the physical norms and standards for every sport discipline;

b) To examine the physiological performance and also the physical abilities assessment of national teams’ athletes;

c) To assess and categorize the Anthropometric characteristics of national teams’ athletes;

d) To propose improvements with the aim of removing the existing problems and weaknesses coming up as a result of the tests.

Note: The six committees shall be responsible for controlling the approved programs being implemented by national federations and evaluate their performance on periodical basis. The committees shall also present regular monthly reports to the Center which shall subsequently be submitted to the Executive Board after being carefully studied, combined and edited.

Article Twenty Four – Main Duties of the Technical Analysis and Evaluation Council:

The main duties of the Technical Analysis and Evaluation Council are as follows:

a) To cooperate with the committees of the Center toward a smooth discharging of duties;

b) To monitor continuously the technical operational programs of the national federations by technical analyzers, and evaluate their performance periodically for presenting reports to the Executive

Board;

c) To present constructive proposals to the Executive Board for improving the national teams’ preparation stages and the performance of the national federations;

d) To supervise and evaluate the performance of the different sections of the Center and to ensure the smooth progress of all the affairs and present reports to the Executive Board; e) To study the condition of teams and athletes in Asia and in the world and develop a comparative study of Afghan teams and athletes vis-à-vis their counterpart contestants with the aim of analyzing the existing situation and anticipating the eventual results of the Afghan athletes and teams. In this regard, the council shall make constructive proposals to the Executive Board.

Note: The technical analyzers shall be selected at the proposal of the Council’s Head from among the individuals who have expertise in different sports disciplines at international level. The selection of such experts shall have to be approved by the Executive Board.

Article Twenty Five: The Executive Board members wishing to attend the meetings of the National Teams’ Monitoring Center and its bodies including those of the six committees may do so. The Secretary General shall supervise the coordination needed to be made in this respect.

Article Twenty Six – The Chefs de Mission of Assigned Delegations: The chef de mission for each sports delegation shall be appointed at least six months before every event by the Executive Board from among the experienced and competent sports managers of the country. The letter of appointment of the appointed chef de mission shall be signed by the President of the Committee. The chefs de mission of Afghan delegations participating in international events shall make all the necessary planning and coordination and shall carefully pursue all the affairs related to the dispatch of delegations and to the relevant management process.

The duties of a chef de mission are as follows:

a) To plan for smooth preparation and support of assigned delegation in collaboration with the Committee’s Secretary General;

b) To select the members of the delegation’s management team from the individuals experienced in international sport missions and propose them to the Executive Board for approval;

c) To convene regular meetings with the concerned officials of national federations for the necessary coordination and resolving any problems hindering the smooth preparation trend of national teams;

d) To pay visits to national teams preparation camps; e) To establish permanent and continuous relations with the Games’ Organizing Committee;

f) To attend the Chefs de Mission meetings held in the host country;

g) To convene regular daily meetings with national teams’ managers during the Games;

h) To make the necessary coordination toward the smooth running of all the affairs related to the assigned delegation;

i) To prepare the final evaluation report of the delegation’s performance upon returning home and present the same to the National Teams’ Monitoring Center for processing, completing, and presenting it to the Executive Board.

Note 1: The letters of appointment of the delegation’s management team members shall be signed by the Secretary General after approval of the Executive Board.

Note 2: The Secretary General, in coordination with the chef de mission, shall take all the necessary measures required for the preparation, dispatch and management of the delegation in the host country and shall supervise and ensure the smooth progress of the relevant affairs.

Article Twenty Seven:

After termination of every international sport event in which the delegation of the Islamic Republic of Afghanistan has participated, particularly after the Olympic and Asian Games, the National Teams’ Monitoring Center, in cooperation with the chef de mission, shall draw up a comprehensive report on the quality of the Games’ affairs and on how the affairs were accomplished during the Games. The report which is to be presented to the Executive Board, shall also contain the performance quality of athletes, coaches and managers of sports teams in each discipline.

Chapter Eight- Commissions and the National Olympic Academy

Article Twenty Eight – Duties of the Commissions: The commissions shall function as decision-planning bodies of the Committee and have the role of consultative working groups, each in its specific field of specialization. Not being involved in the operational side of the duties of the Committee, the commissions shall assist the Executive Board in making decisions on the relevant issues.

Article Twenty Nine – Number and Composition of Commissions: The commissions of the Committee are as follows:

1- Management and Planning Commission 2- International Relations Development Commission 3- Resources Development and Marketing Commission 4- Media Commission 5- Athletes Commission 6- Sports Law Commission 7- Coaches Commission 8- Sport for All Commission 9- Women and Sport Commission 10- Sport Tourism Commission 11- Education and National Olympic Academy Commission 12- Sport Medicine Commission 13- Sport and Environment Commission

Note 1: Every commission shall be composed of a chairman, a secretary and 3 to 5 members appointed for a two–year term. Re–appointment of the commission members is possible.

Note 2: The chairmen of commissions shall be appointed by the Executive Board and their letters of appointment shall be signed by the President of the Committee.

Note 3: The secretary and members of each commission shall be proposed by the chairman of the commission and their letters of appointment shall be signed by the Secretary General after the approval of the Executive Board.

Note 4: The Executive Board may, according to needs and in keeping with the list of IOC commissions, change the number, structure, titles and duties of the commissions. However, the number of commissions shall not, at any case, exceed 15 and the number of the members of each commission shall not be more than 8 persons.

Note 5: Athletes’ Commission (Note: This Commission shall be established in accordance with the IOC guidelines and Notes 1, 2, 3 and 4 of this article do not apply to this commission).

Note 6: Each commission shall draw up a bye-law for itself that has to be approved by the Executive Board.

Article Thirty – The National Olympic Academy: The National Olympic Academy is a scientific, educational, research, cultural and art center which is affiliated to the Committee.

Note 1: The Education and National Olympic Academy Commission in cooperation with the Management and Planning Commission shall prepare the statutes of the Academy concentrating the committees’ activities in educational, research, scientific and cultural fields in the Academy. The statutes of the Academy must be approved by the Executive Board.

Note 2: President of the Academy is appointed by the Executive Board from among managers who have expertise on science and education with at least a Bachelor’s Degree qualification and three years of sports management background in the country. The letter of appointment for the Academy President shall be signed by the President of the Committee.

Chapter Nine – Financial Affairs

Article Thirty One – Treasurer: With the observance of the current rules and regulations and of the relevant bye-laws and in the framework of the Executive Board’s decisions, the Treasurer shall stabilize the Committee’s finances according to the orders of the President or the Secretary General.

Article Thirty Two: The Treasurer shall contribute and supervise the collection of membership fees, financial grants and donations and shall do his best to collect debts, secure credits and raise the revenues of the Committee. He shall also ensure the smooth running of finances and accounting and shall regulate the accounts and financial documents.

Article Thirty Three: The Treasurer shall prepare the annual financial report of the Committee in coordination with the Secretary General. The annual audited financial report shall have to be approved by the Executive Board and the General Assembly.

Article Thirty Four: The Treasurer shall prepare the annual budget of the Committee in coordination with the Secretary General. The budget shall have to be approved by the Executive Board and the General Assembly.

Article Thirty Five: The Executive Board shall nominate to the General Assembly an official auditor (true or legal) to endorse the financial statements of the Committee. The appointment of the nominated auditor shall be subject to the approval of the General Assembly. The auditing of accounts must be based on internationally–recognized accounting and auditing standards.

Article Thirty Six- Sources of Revenues:

The finances and revenues of the Committee shall be derived from the following sources:

a) Budget and credits allotted through government aid. In line with the instructions specified in the Olympic Charter, no interference in return to the government’s financial aid which may impair the independence of the Committee shall be permitted;

b) Financial donations and grants made by true and legal persons; c) Revenues derived from competitions and hosting sport events; d) Revenues collected by the Committee in holding Olympic Day or Week; e) Revenues derived from the sale of stamps, sport coins, Olympic and Asian logos and emblems subject to prior approval of the International Olympic Committee or the Olympic Council of Asia; f) Income derived from the marketing activities carried out by economic institutions affiliated to the Committee;

g) Income derived from advertisement contracts and financial sponsors; h) Other revenues as approved by the Executive Board

Article Thirty Seven – Expenditure All the revenues and incomes of the Committee shall be spent in keeping with an annual budget approved by the Executive Board and the General Assembly in line with the objectives and duties of the Committee as specified in the present Statutes. The balance of revenues and expenditure shall be presented to the General Assemblyfor approval.

Article Thirty Eight: All financial documents and payments shall be valid with the signatures of two out of three persons, namely the President or Secretary General and Treasurer, with the signature of the Treasurer being always obligatory.

Chapter Ten- Miscellaneous

Article Thirty Nine: The Executive Board may invite persons who have rendered outstanding services to the cause of sport and Olympism to assist as advisors in the affairs of the Committee.

Article Forty: Any proposal for amendment(s) to the Statutes shall be submitted to the Executive Board which shall present it to the General Assembly for consideration and decision.. The Statutes and subsequent amendments to it must, at all times, be in compliance with the Olympic Charter and must be approved by the International Olympic Committee. The amendments shall only come into force if approved by the IOC.

Article Forty One:

If there is any doubt as to then signification or interpretation of these Statutes, or if there is a contradiction between these Statutes and the Olympic Charter, the latter takes precedence.

Article Forty Two – Disputes Resolution and Arbitration:

Any sports-related disputes within the Committee shall be resolved by the competent bodies of the Committee, with the General Assembly being the supreme decision-making body of the Committee. For that purpose the General Assembly may decide to make a final decision, or the General Assembly may decide to establish any conciliation, mediation or arbitration body to resolve the dispute.

Any final decision made by the General Assembly in the dispute in question or by the conciliation, mediation or arbitration body set up for that purpose may be submitted exclusively by way of appeal to the Court of Arbitration for Sport (CAS) in Lausanne, Switzerland, which will resolve the dispute definitively in accordance with the Code of Sports Related Arbitration. The time-limit for appeal is twenty-one days (21 days) after the reception of the decision concerning the appeal.

Note: Any dispute arising on the occasion of, or in connection with, the Olympic Games shall be submitted exclusively to the Court of Arbitration for Sport (CAS), in accordance with the Code of Sports-Related Arbitration.

Article Forty Three:

The Committee may be dissolved by decision of three Fourth of the voting members present at an Extraordinary General Assembly convened specifically for that purpose (provided that the quorum is met). In case of dissolution, the Committee’s assets and properties will be transferred to the legal successor of the Committee (if any) or, if not, to an organization and/or entities pursuing similar objects of the Committee, as per the Committee’s decision and subject to prior consultation and coordination with the IOC.

The present Statutes was adopted by the General Assembly of the National Olympic Committee of the Islamic Republic of Afghanistan in its meeting held on March 20, 2014 and was approved by the International Olympic Committee on…………
